Your right to drive to your home is at risk!

Think not? This road is a RUPP. You might not realise it, but it could soon become a Restricted Byway.

To use a Motor Vehicle on it will be an offence UNLESS you have an easement OR you can prove Public Vehicular Rights. Mere use for the last 70 years is not sufficient. "If it is only a footpath, that use is illegal and therefore does not count".

Unless you can PROVE there were vehicular rights BEFORE the proposed legislation takes effect, it will become an RB and an easement must be bought from the various landowners of the road, IF you can identify them, and of course assuming you have not upset them. And that you can afford to pay what they ask!

It you can prove there were vehicular rights, you are OK, well nearly.............

1) You must find out if you live on a RUPP, or a Bridleway or a Footpath.

2) Then get your deeds out of the Building Society or Solicitor's vaults, and find out if you have an easement. For ALL purposes (not just agricultural purposes for example).

3) If not, you must apply for an easement, with your proof of motor vehicular use from pre 1910, or other documentary evidence.

4) You must hope that no one lodges an objection to the application

5) You must hope that you do not wish to sell before the application (along with quite a few others), is determined.

The yellow road below Glasnant is a FOOTPATH. By driving on it you will be committing a criminal offence, and your vehicle could be confiscated. What does it look like?

How would you know this road is only a Footpath? Where does it lead:-

It could just as easily be to a Golf Club, a Paddock, Angler's pool or river or Model Flying Club site.

You are too old to want to take a mountain bike to a remote byway on the back of the car, or operate Amateur Radio equipment on a distant Hilltop, or Canoe on a remote river? Pity, you soon won't be able to be taken for a peaceful drive in the Country, RUPPs and BOATs are all to be closed. These are the MPs that wish to do just that.

There are few people in this Country that will not be affected in some way or other, whether in making a handsome windfall profit out of the misery of others, or of the loss of many byways that you have been able to drive, as of right, for all of your life.

Is this is a legitimate hobby or a spectator interest? This Hill Climb trial is on a Byway at Far Gatton, Shropshire, and authorised by the MSA (Motor Sports Association). To run an event like this, or to access an event at any site along a Restricted Byway will be prohibitively expensive and complex to negotiate access rights with every landowner with a claimed interest - IF they ALL agree to access!
